These Terms of Service (“Terms”) govern your access to and use of the services provided by Find My Gabriel (“we,” “us,” or “our”) on the subdomain sightings.findmygabriel.org. By uploading content or using this website, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

• You must be at least 13 years old to use this service.
• We reserve the right to restrict access from certain IP addresses at our discretion.

2. Content Ownership & Licensing

• You retain ownership of any photos you upload.
• By submitting content without your name, you grant us a license under CC0 1.0 Universal, or a similar open license, allowing us to use, display, distribute, and adapt your content.
• By submitting your name and content, you grant us a license under CC-BY 4.0 International, or a similar open license, allowing us to use, display, distribute, and adapt your content.
• Uploaded photos will be publicly visible on the website.

3. Prohibited Content

You agree not to upload content that is:

• Offensive, harmful, illegal, or deceptive
• False, manipulated, or AI-generated
• Photos that do not include Gabriel
• Not owned by you, or that you do not have the rights to share

We reserve the right to remove content at our sole discretion. Before uploading, ensure that your photo complies with all applicable privacy laws in your area.

4. Privacy & Data Use

• We may collect personal information you provide (e.g., name, email) and data automatically collected when you visit the site (e.g., IP address, cookies, metadata).
• There is no warranty that metadata (such as GPS coordinates) will or will not be removed from uploaded photos.

5. Disclaimers & Liability

• We do not guarantee the accuracy, reliability, or authenticity of uploaded sightings.
• We are not responsible for damages resulting from reliance on user-submitted content.
• You agree to indemnify and hold harmless Find My Gabriel, its Board of Trustees, and affiliates from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

6. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington. Any disputes shall first be resolved through mediation, followed by binding arbitration conducted in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Clark County, Washington. Costs of disputes shall be borne by the party initiating the claim. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction.

7. Changes to Terms

We may update these Terms at any time without prior notice. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.
